Legal Aid is no longer available for divorce or civil partnership dissolution, with the following exceptions:
Domestic Abuse: Legal aid is available for individuals with low income who need injunctions or legal assistance related to financial matters and child arrangements if they are experiencing domestic abuse. This includes physical abuse, emotional abuse, and controlling behaviors. Evidence of abuse is required, and a solicitor can guide you on what constitutes acceptable evidence.
Mediation: Legal aid may cover mediation costs for disputes involving finances or child arrangements, aiming to help resolve matters without court intervention.
Child Abduction Cases: Legal aid is available for cases involving child abduction, either outside the UK or if a child has been unlawfully removed within the UK.
Risk of Homelessness: Legal aid can be accessed if there is a risk of losing your home due to threats from your spouse or partner.
Forced Marriage: Legal aid is available for individuals threatened with or forced into marriage, including the application for a Forced Marriage Protection Order.
If You Are Ineligible for Legal Aid:
Seek Amicable Resolution: Attempt to resolve matters amicably through negotiation or mediation to avoid the costs and length of a court process.
Represent Yourself: You may choose to represent yourself in court. Various organisations and resources are available to assist self-representing individuals. Click here for resources.
Public Access Barrister: You can hire a barrister directly through the ‘public access’ scheme. This allows barristers to represent clients without needing a solicitor as an intermediary, and some may offer reduced fees for those on low incomes.
This overview reflects the current state of legal aid in England and Wales.
