Ending a Civil Partnership

Civil partnerships and marriages are very similar in UK law. However, there are a few key differences, especially when it comes to how they legally end.

What is a civil partnership?

A civil partnership is a legally recognised relationship between two people.

It gives almost identical legal rights and responsibilities to marriage. This includes rights around finances, inheritance, pensions and parental responsibility.

Since 2019, civil partnerships have been available to both same-sex and opposite-sex couples in England and Wales.

Is ending a civil partnership the same as divorce?

The process is very similar, but the terminology is different.

The legal process of dissolution follows the same structure as divorce under the no-fault system.

This means you only need to confirm that the relationship has irretrievably broken down.

What is the legal process for dissolving a civil partnership?

The process mirrors the legal process of divorce.

It includes:

  • An application (individual or joint)
  • A 20-week reflection period
  • A Conditional Order
  • A Final Order

The same timelines apply, so most cases take at least six months.

Are there any key differences?

There are a few important distinctions.

Grounds for ending the relationship

You cannot cite adultery as a reason in civil partnership dissolution.

However, this is less relevant now because of no-fault divorce and dissolution, where no reason needs to be given.

Terminology

The legal terms differ slightly:

  • Divorce → Dissolution
  • Decree Absolute → Final Order
  • Decree Nisi → Conditional Order

In practice, the process is almost identical.

Religious context

Marriage can be religious or civil.

Civil partnerships are purely civil, although some couples choose to have a ceremony.

What about finances and children?

There is no difference.

Financial settlements, property division, pensions and maintenance are handled in exactly the same way as divorce.

Child arrangements are also treated the same. The court will always prioritise the child’s welfare.

Do I need a solicitor for civil partnership dissolution?

You do not always need one.

If everything is agreed, you may be able to handle the process yourself. However, if there are disputes about finances or children, legal advice is strongly recommended.
